By accessing or using Vocua ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, you may not use the Service. The Service is operated by [Your Name], [Your Address], Vienna, Austria ("we", "us", "our").

2. Description of Service

Vocua is a web-based flashcard and spaced repetition learning application. The Service allows you to create templates, entries, and collections of flashcards, study them using spaced repetition algorithms, and optionally use AI-powered features to assist with card creation.

3. Account Registration

To use the Service, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 16 years of age to create an account.

4. User Content

You retain ownership of all content you create within the Service, including templates, entries, and uploaded files. You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you. We do not claim any ownership rights over your content.

5. Bring Your Own Key (BYOK)

The Service offers optional AI features powered by third-party providers (e.g., Google Gemini, OpenAI). When you use the BYOK feature, you provide your own API key and agree to the terms of service of the respective AI provider. We store your API key securely but are not responsible for charges incurred with your AI provider or for the content generated by third-party AI services.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on intellectual property rights of others
• Attempt to gain unauthorized access to the Service or its systems
• Use automated tools to scrape, crawl, or otherwise extract data from the Service
• Interfere with or disrupt the Service or its infrastructure

7. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable for any loss or damage resulting from service interruptions.

8. Intellectual Property

The Service, including its design, code, and branding, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

9. Termination

You may delete your account at any time through the Settings page. Upon deletion, all your data will be permanently removed. We reserve the right to suspend or terminate accounts that violate these Terms.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

These Terms are governed by the laws of the Republic of Austria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Vienna, Austria. If you are a consumer within the EU, you may also bring proceedings in the courts of your country of residence.
